General Terms and Conditions of PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED

§1
The following terms and conditions represent the general terms and conditions of PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED They apply to all legal transactions concluded between PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED and the users of the services offered by them. They also apply to the initiation of legal transactions and legal actions similar to legal transactions between PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED and the users of the services offered by them.

§2
Users are all natural or legal persons who make use of the services offered by PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED.

§3
The application of any deviating terms and conditions of the user is excluded.

§4
PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED is entitled to modify their general terms and conditions at any time and without giving reasons. In the event of a modification, they will send the user the modified general terms and conditions via email. The modified general terms and conditions shall be deemed agreed upon between Puzzlepie and the user if the user does not object to their validity within 14 days of receiving the email. The objection must be in written form. In the email, PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED informs the user about the possibility of objecting to the modification, the written form requirement, the objection period, and the consequences of not raising an objection.

§5
Minors and other persons who are not or only partially legally competent are excluded from using the services offered below.

§6
PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED offers the following services on their online platform:

Mediation of rental agreements in the event sector between PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED and the user.
Mediation of services in the event sector between PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED and the user.
Provision of informational material from the event sector.
In the event of rental or service contracts being concluded or initiated, only the respective users are parties to the contract. PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED is not a contracting party.

§7
The liability of PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED is limited to damages or futile expenses incurred by the user, which result from a breach of material contractual obligations by PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED and which are typically foreseeable.

The limitation of liability does not apply in cases of gross negligence or willful misconduct. Furthermore, the limitation of liability does not apply to damages resulting from the violation of life, body, or health of a person or for which liability is provided under the Product Liability Act.

§8
The contract between PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED and the user only comes into effect when the user accepts an offer in writing, either by postal mail or email, which they have received based on their online inquiry.

By accepting an offer, the user hereby agrees to the general terms and conditions and confirms not to be excluded from using the services according to § 5.

The user is obligated to provide accurate and complete information requested during the acceptance of the offer. If these data change afterwards, the user is obliged to inform PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED about these changes in writing.

Puzzlepie is entitled to reject the creation of an offer without giving reasons.

§9
The objects (rental items), services offered, project tenders, and all other contractual objects depicted on the website of PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED, as well as the indicated prices, do not constitute an offer for the conclusion of a rental contract. All information is non-binding.

Originals or copies of works protected by copyright or related rights may only be rented with the consent of the rights holder. This applies, except for buildings and works of applied art, even if the original or copy has been put into circulation with the consent of the authorized distributor and the lessor has lawfully acquired the original or copy of the work.

§10
The rental period begins at the time of delivery of the equipment to the customer or at the time of pickup at the premises of PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED and ends at the agreed time of pickup by the customer or return to PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED premises. The minimum rental period is one day. If the contracted logistics company is unable to meet the customer at the agreed return time, the rental period is extended until the actual pickup time. Delivery and return times, unless expressly agreed otherwise, must be on weekdays between 10:00 a.m. and 6:00 p.m.

§11
The prices, unless otherwise stated, are net prices in euros, plus the legally required value-added tax, and are subject to change without notice - errors excepted. Price changes due to, for example, exchange rate fluctuations are expressly reserved.

Deposits will be refunded to the renter upon the return of the equipment, including all accessories, in undamaged condition. In the event of late return of the equipment, an additional rental amount will be deducted from the deposit according to the valid price list of PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED. Any remaining balance will be refunded to the renter.

If the renter returns the rental items damaged or not at all (in the case of theft), PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED will initially retain the deposit and have the defective rental items repaired or replaced, or in the case of impossibility or uneconomical repair, purchase replacement devices. If the repair costs exceed the deposit or the replacement value of the rental items, negative amounts will be invoiced with immediate maturity.

§12
The customer has the option to withdraw from the contract without stating reasons up to 1 month before the start of the rental/setup without any cancellation fees. If the customer cancels within 1 month before the start of the rental/setup, 100% of the order amount is due.

§13
Immediately upon receipt of the equipment, the renter must check it for integrity and functionality. The renter is obliged to handle the rental item with care. They are liable for any damages arising from gross negligence and theft. Rental items, including accessories, must be returned in perfect condition on the agreed date. Non-returned or lost accessories will be invoiced to the renter at their replacement value.

If there are rental items that require a construction approval or notification to the authorities, the lessor must inform the renter. The renter is responsible for carrying out any necessary official steps or inspections.

§14
Complaints regarding poor, incorrect, or deficient deliveries or services must be reported to PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED immediately by phone or email upon receipt of the delivery. Therefore, the renter must immediately check the equipment for integrity and completeness upon receipt. The lessor must be given the opportunity to remedy the defect in the rental equipment or provide other similar rental equipment. If the renter fails to notify PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED (by phone or email) immediately of any defects, the renter's claims for reduction, withdrawal, conversion, or compensation are excluded.

§15
PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED assumes no liability or obligation for damages and consequential damages, regardless of the legal grounds. The disclaimer of liability applies in particular to:

Failure to enter into the rental agreement, e.g.,
due to damage to the rental item during transport or at the customer's premises
due to non-availability caused by delayed return of the equipment by previous renters or
due to unforeseen delays in delivery.
Malfunctions or complete failure of the rental item.

Any resulting consequential damages, whether direct or indirect, including loss of earnings or lost profits.

Improper installation of the equipment and resulting damages. Any claims by third parties (e.g., GEMA) in public events are the responsibility of the organizer.

§16
Payments are to be made in cash upon collection of the goods or by advance bank transfer unless otherwise expressly agreed in writing with the customer. Cash discounts or deductions for any other reason are not permitted. Rental fees are to be paid in advance unless otherwise agreed in writing.

§17
The customer agrees that PUZZLEPIE EVENT ENGINEERING ZAMBIA LIMITED may store and automatically process personal data received in the course of business relations. If individual provisions of the terms and conditions are or become ineffective, the validity of the remaining provisions shall not be affected. Oral agreements are not valid.

If the user is a merchant, a legal entity under public law, or a special public fund, or if the user does not have a general place of jurisdiction in Zambia, the place of jurisdiction for all claims arising from the contractual relationship is Lusaka.

The contract is exclusively governed by the laws of the Republic of Zambia.

If individual clauses of the contract are invalid, the statutory provisions shall apply.
